NCC NEWS | Mudança da Portaria de lâmpada LED

Prezados,
Visando em lhes ajudar a entender as pequenas diferenças entre as Portarias antigas nº 389, de 25 de agosto de 2014 e 144 de 13 de março de 2015 para a nova Portaria consolidada nº 69, de 16 de fevereiro de 2022, resumimos em poucos itens:
– Houve a inclusão do artigo 6º abaixo que ressalta que todos os pontos de venda deverão ostentar a ENCE, inclusive no comércio virtual que, alternativamente, as informações nela constantes em formato de texto, em todas as páginas onde haja oferta ou exibição do produto, de forma ostensiva, clara e unívoca na imagem ou identificação do modelo do produto.
“Art. 6º. O comércio de lâmpadas LED com dispositivo de controle integrado à base, em estabelecimentos físicos ou virtuais, fica sujeito ainda às seguintes obrigações:
• 1º Os produtos deverão, no ponto de venda, ostentar a ENCE, de forma claramente visível ao consumidor, sem que sua visualização seja obstruída por qualquer outra informação anexada pelos fornecedores.
• 2º No comércio virtual, é de responsabilidade do administrador do site disponibilizar a ENCE ou, alternativamente, as informações nela constantes em formato de texto, em todas as páginas onde haja oferta ou exibição do produto, de forma ostensiva, clara e unívoca na imagem ou identificação do modelo do produto.
• 3º Em catálogos de venda e em material publicitário físico ou virtual, a ENCE ou, alternativamente, as informações nela constantes em formato de texto, devem estar disponíveis de forma clara e unívoca na imagem ou identificação do modelo do produto. ”
– Mudança na potência consumida pela lâmpada, a tolerância de desvio entre potência nominal e potência medida mudou: antes era limitado o desvio a uma variação de +10%. Agora o limite é de ± 10%.
“Item 3.1.1 – A potência consumida pela lâmpada não pode variar para além da tolerância de ±10% em relação à potência nominal declarada. ”
– Houve a alteração da validade do certificado, antes eram 3 anos e agora sua validade tem 4 anos:
“6.1.1.6.1 Os critérios para Emissão do Certificado de Conformidade devem seguir as condições descritas no RGCP. O Certificado de Conformidade tem validade de 4 (quatro) anos, contados da data de emissão. ”
– Ressaltamos os itens abaixo que se manteve pela portaria anterior, que é muito importante a apresentação destes documentos de forma correta:
“Nota 2: Cabe ao OCP solicitar a comprovação de que o relatório IESNA LM-80-08seja de fato do modelo do LED que está sendo usado nas lâmpadas em questão. Esta comprovação deve ser por meio que comprove a compra do LED indicado e pela declaração do fabricante de que esteja utilizando o LED citado em cada um dos modelos de lâmpadas submetidas à análise.
• f) DataSheet / Part Number de todos os componentes eletrônicos da Lâmpada LED e Curva de Life time x temperatura dos capacitores eletrolíticos, se aplicável.”

In order to help you understand the small differences between the old Ordinances No. 389, of August 25, 2014 and No. 144, of March 13, 2015 and the new Ordinance No. 69, of February 16, 2022, we summarized in a few items:
– There was the inclusion of article 6 below, which emphasizes that all points of sale must display ENCE, including in virtual commerce that, alternatively, the information contained therein in text format, on all pages where there is an offer or display of the product, ostensibly, clearly and unequivocally in the image or identification of the product model.
“Art. 6th. The sale of LED lamps with a control device integrated into the base, in physical or virtual establishments, is also subject to the following obligations:
• 1 The products must, at the point of sale, bear the ENCE, clearly visible to the consumer, without their viewing being obstructed by any other information attached by the suppliers.
• 2 In virtual commerce, it is the responsibility of the website administrator to make ENCE available or, alternatively, the information contained therein in text format, on all pages where there is an offer or display of the product, in an ostensible, clear and univocal way in the image or product model identification.
• 3 In sales catalogs and physical or virtual advertising material, the ENCE or, alternatively, the information contained therein in text format, must be clearly and unambiguously available in the image or identification of the product model.”
– Change in the power consumed by the lamp. The tolerance between the rated power and measured power has changed: before it was the variation was limited to +10%. Now the variation is limited in ± 10%.
“Item 3.1.1 – The power consumed by the lamp cannot vary beyond a tolerance of ±10% in relation to the declared rated power.”
– There was a change in the validity of the certificate, before it was 3 years and now its validity is 4 years:
“6.1.1.6.1 The criteria for issuing the Certificate of Conformity must follow the conditions described in the RGCP. The Certificate of Conformity is valid for 4 (four) years from the date of issue.”
– We emphasize the items below that were maintained by the previous ordinance, which is very important to present these documents correctly:
“Note 2: It is up to the OCP to request proof that the IESNA LM-80-08 report is in fact the LED model being used in the lamps in question. This proof must be by means of proving the purchase of the indicated LED and by the manufacturer’s declaration that he is using the LED mentioned in each of the lamp models submitted for analysis.
• f) DataSheet / Part Number of all electronic components of the LED Lamp and Lifetime Curve x temperature of electrolytic capacitors, if applicable.”
