NCC NEWS | Ex (Inmetro Ordinance nº 115/2022) – Obligation of the Applicant/Supplier/Holder and the Company responsible for Handling Complaints to be legally established in Brazil

According to the new Inmetro Ordinance #115/2022 for Explosive Atmosphere, which came into force on April 1, 2022, we inform you that the deadline for adequacy of the Certificate Applicant/Supplier/Holder expires on April 1, 2024:

Art.10A. The certificates issued based on sub-item 4.18 of Inmetro regulation 179 of May 18, 2010, must be in conformity with Annex I within 24 (twenty-four) months from the effective date of the regulation.

6.1.1.1 Certification Request
The supplier must submit a formal request to the OCP, providing the documentation described in the RGCP.

6.2.1 Certification Request
6.2.1.1 Certification must be requested exclusively by the Supplier*, and must follow the established in the RGCP (Regulation #200/2021) and Regulation #115/2022.

56- Supplier (Distributor/ Importer) – Legal entity, public or private, legally established in the country, which develops production, assembly, creation, construction, transformation, import, export, recovery, repair, fractionation, packaging, distribution, or marketing of products regulated by INMETRO.
According to the new Inmetro Ordinance #115/2022 for Explosive Atmosphere, which came into force on April 1, 2022, we inform you that the company responsible for Handling Complaints must be legally established in Brazil:

Criteria for handling complaints must follow the requirements established in the RGCP.

The handling of complaints described in this document applies to the Supplier requesting the certification and the OCP.
Note: the same company can be both described above.

De acordo com a nova Portaria Inmetro nº 115/2022 para Atmosferas Explosivas, que entrou em vigor em 1º de abril de 2022, informamos que o prazo para adequação do Certificado Requerente/Fornecedor/Titular termina em 1º de abril de 2024:

Art.10A. Os certificados emitidos com base no subitem 4.18 da Portaria Inmetro 179 de 18 de maio de 2010, deverão estar em conformidade com o Anexo I no prazo de 24 (vinte e quatro) meses a partir da data de vigência da norma.

6.1.1.1 Solicitação de Certificação
O fornecedor deve encaminhar solicitação formal ao OCP, fornecendo a documentação descrita no RGCP.

6.2.1 Solicitação de Certificação
6.2.1.1 A certificação deverá ser solicitada exclusivamente pelo Fornecedor*, devendo seguir o estabelecido no RGCP (Regulamento nº 200/2021) e Regulamento nº 115/2022.

56- Fornecedor (Distribuidor/ Importador) – Pessoa jurídica, pública ou privada, legalmente estabelecida no país, que desenvolve produção, montagem, criação, construção, transformação, importação, exportação, recuperação, reparo, fracionamento, embalagem, distribuição ou comercialização de produtos regulamentados pelo INMETRO.
De acordo com a nova Portaria Inmetro nº 115/2022 para Atmosferas Explosivas, que entrou em vigor em 1º de abril de 2022, informamos que a empresa responsável pelo Tratamento de Reclamações deve estar legalmente estabelecida no Brasil:

Os critérios para tratamento de reclamações devem seguir os requisitos estabelecidos no RGCP.

7. TRATAMENTO DE RECLAMAÇÕES
O tratamento de reclamações descrito neste documento se aplica ao Fornecedor solicitante da certificação e ao OCP.
Nota: a mesma empresa poderá ocupar os dois papéis descritos acima.
